Who is Eligible for Aid and Attendance?

The Voeller Law Firm | Jul 13, 2021 | Elder Law

Military veterans serve our country and help to protect our freedom, often risking their lives in the performance of their duties. Because of this, the Department of Veterans Affairs has established a special Pension Program that provides Aid and Attendance benefits to many veterans to help pay for long-term care expenses. These benefits are tax-free and can range from about $1100 to $2100 per month. A recipient of these benefits can receive them for the duration of his or her life. The best way to see if you meet the qualifications for these benefits is to consult with a Texas Aid and Attendance attorney. This attorney can help you determine whether you’re eligible and can guide you through the application process.

Eligibility Requirements

There are several eligibility requirements that must be met before a veteran may qualify for Aid and Attendance benefits. These fall into the categories of a Service Requirement, a Health Requirement, and an Income Requirement. There are also defined periods of wartime during which the applicant must have served. Each applicant must have served at least one day during a period of war and must also have served at least 90 days of active duty. Applicants must also have not had a dishonorable discharge. Successful applicants must need assistance with activities of daily living or be residing in a nursing home or must be legally blind. An experienced attorney can help you determine your eligibility and can help you get all the benefits to which you are entitled.
